Distance Selling Agreement

1. Parties

This Distance Selling Agreement ("Agreement") is entered into electronically between:

Seller

CheckOpss

("Seller")

and

The individual or legal entity purchasing a subscription through the CheckOpss platform ("Customer").

By completing the purchase, the Customer accepts this Agreement electronically.


2. Subject

This Agreement governs the sale, delivery, use, cancellation, and refund conditions of digital subscription services provided through the CheckOpss platform.


3. Service Description

CheckOpss is a cloud-based Software as a Service (SaaS) platform that provides digital tools for:

  • Operational management

  • Inspection management

  • Audit management

  • Checklist management

  • Asset management

  • Maintenance management

  • Reporting

  • Team collaboration

  • Workflow management

The purchased service is delivered electronically.

No physical goods are shipped.


4. Pricing

Subscription prices are displayed before purchase.

Prices may include or exclude applicable taxes depending on the customer's country and local tax regulations.

Recurring subscriptions renew automatically unless cancelled.


5. Payment

Payments may be processed by authorized third-party payment providers.

Accepted payment methods may include:

  • Credit Card

  • Debit Card

  • Other electronic payment methods offered during checkout

The Seller does not store complete payment card information.


6. Delivery

The purchased subscription is delivered electronically.

Access is typically activated immediately after successful payment.

In exceptional circumstances, activation may require additional verification.


7. Subscription Renewal

Unless otherwise specified:

  • Monthly subscriptions renew every month.

  • Annual subscriptions renew every year.

The Customer may cancel automatic renewal before the next billing cycle.

Cancellation does not automatically refund amounts already paid for the current billing period.


8. Right of Withdrawal

Because CheckOpss provides digital content and online services that begin immediately after purchase, the Customer expressly agrees that service delivery may commence before the withdrawal period expires.

Where permitted by applicable law, once digital service delivery has begun with the Customer's consent, the statutory right of withdrawal may no longer apply.

If mandatory consumer protection laws in the Customer's jurisdiction provide additional rights, those rights remain unaffected.


9. Cancellation

Customers may cancel future subscription renewals at any time through their account settings or by contacting customer support.

Cancellation prevents future charges but does not automatically terminate access to the already-paid subscription period.


10. Refund Policy

Refund requests are evaluated according to applicable law and the Seller's refund policy.

Refunds generally may be granted in situations including:

  • Duplicate payments

  • Technical issues preventing service delivery

  • Billing errors

  • Other circumstances required by applicable consumer protection laws


11. Customer Responsibilities

The Customer agrees to:

  • Provide accurate information.

  • Keep login credentials secure.

  • Use the platform lawfully.

  • Avoid unauthorized access attempts.

  • Comply with all applicable laws and regulations.


12. Seller Responsibilities

The Seller agrees to:

  • Provide the purchased digital service.

  • Maintain reasonable service availability.

  • Protect customer data in accordance with the Privacy Policy.

  • Deliver customer support within reasonable limits.


13. Service Availability

Although CheckOpss aims to provide uninterrupted access, temporary interruptions may occur due to:

  • Scheduled maintenance

  • Security updates

  • Infrastructure failures

  • Force majeure events

  • Internet connectivity issues

The Seller is not responsible for interruptions beyond its reasonable control.


14. Limitation of Liability

To the maximum extent permitted by law, the Seller shall not be liable for indirect, incidental, consequential, or special damages arising from the use of the platform.

Nothing in this Agreement excludes liability that cannot legally be excluded under applicable law.


15. Governing Law

This Agreement shall be governed by the laws applicable to the Seller's place of establishment, unless mandatory consumer protection laws of the Customer's country require otherwise.


16. Changes to the Agreement

The Seller may update this Agreement from time to time.

Updated versions become effective upon publication on the CheckOpss website or platform.
