CheckOpss Subscription Terms

1. Introduction

These Subscription Terms ("Terms") govern the purchase, renewal, cancellation, and use of paid subscription plans offered by CheckOpss ("CheckOpss", "we", "our", or "us").

By subscribing to a paid plan, you agree to these Subscription Terms.


2. Subscription Plans

CheckOpss offers one or more subscription plans that may vary in:

  • Features

  • User limits

  • Storage capacity

  • Usage limits

  • Organization size

  • Support level

  • Available integrations

Current plans and pricing are displayed on our website or within the application.


3. Billing

Subscriptions are billed in advance according to the selected billing cycle.

Available billing periods may include:

  • Monthly

  • Annual

All applicable taxes, VAT, or similar charges may be added where required by law.


4. Automatic Renewal

Unless cancelled before the renewal date, subscriptions automatically renew at the end of each billing cycle using the payment method on file.

By purchasing a subscription, you authorize recurring charges until cancellation.


5. Free Trial

If a free trial is offered:

  • No payment may be required during the trial period unless stated otherwise.

  • At the end of the trial, the subscription may automatically convert to a paid plan unless cancelled before the trial expires.

  • Trial eligibility may be limited to one trial per organization or account.


6. Plan Changes

Customers may upgrade or downgrade their subscription.

Upgrades generally take effect immediately.

Downgrades usually become effective at the start of the next billing cycle unless otherwise specified.

Feature availability depends on the selected subscription plan.


7. Subscription Cancellation

Customers may cancel automatic renewal at any time through their account settings or by contacting customer support.

Cancellation:

  • Stops future billing.

  • Does not automatically refund payments already made.

  • Does not remove access until the current billing period ends.


8. Refunds

Subscription fees are generally non-refundable except where:

  • Required by applicable law;

  • Duplicate payments occur;

  • Billing errors occur;

  • Technical issues prevent service activation;

  • We expressly approve a refund.

Approved refunds are processed using the original payment method whenever possible.


9. Failed Payments

If payment cannot be successfully processed:

  • We may retry the payment.

  • Subscription benefits may be limited or suspended.

  • Access may be restricted until payment is successfully completed.

  • Continued non-payment may result in account suspension or termination.


10. Taxes

Customers are responsible for any applicable taxes unless otherwise stated.

Where required, VAT or similar taxes will be collected during checkout.


11. Subscription Features

Each subscription may include limits relating to:

  • Organizations

  • Users

  • Assets

  • Checklists

  • Reports

  • Storage

  • API usage

  • Notifications

  • Integrations

Exceeding plan limits may require upgrading to another subscription plan.


12. Enterprise Plans

Enterprise subscriptions may include:

  • Custom pricing

  • Custom agreements

  • Dedicated support

  • Service Level Agreements (SLA)

  • Custom integrations

  • Additional security features

Enterprise agreements may supersede portions of these Subscription Terms where expressly stated.


13. Suspension and Termination

We may suspend or terminate subscriptions if:

  • Payment obligations are not fulfilled.

  • Fraudulent activity is detected.

  • The platform is used unlawfully.

  • These Terms or our Terms of Service are materially violated.

Where practical, reasonable notice will be provided before suspension.


14. Price Changes

We may update subscription pricing from time to time.

Existing subscribers will be notified in advance of any material pricing changes before such changes take effect for future billing periods.


15. Availability of Features

We continuously improve CheckOpss.

Features may be added, modified, replaced, or discontinued as part of ongoing product development.

Where feasible, material changes affecting paid functionality will be communicated in advance.


16. Data After Cancellation

After subscription expiration:

  • Access to premium features may end.

  • Data may remain available for a limited retention period, subject to our Privacy Policy and applicable agreements.

  • After the applicable retention period, data may be permanently deleted unless legally required to be retained.

Customers are responsible for exporting their data before account closure where applicable.


17. Limitation of Liability

To the fullest extent permitted by law, CheckOpss shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from subscription use.

Nothing in these Terms limits liability that cannot legally be excluded.


18. Changes to These Terms

We may modify these Subscription Terms from time to time.

The updated version becomes effective upon publication unless otherwise stated.

Continued use of the subscription after changes become effective constitutes acceptance of the updated Terms.
